1. Who we are
trycodez.com and the Code Z checkout pages, including get.trycodez.com (together, the "Site"), are operated by Jorgensen Holdings LLC ("Code Z," "we," "us"), 30 N Gould St, Ste N, Sheridan, WY 82801, United States. By visiting the Site or buying from us, you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the Site.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to make a purchase.
3. Products and health information
Code Z is a dietary supplement. *These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.
Information on the Site is for general education only and is not medical advice. Consult your physician before use, especially if you are pregnant or nursing, under 18, have a medical condition, or take prescription medication (including blood thinners, sedatives or antidepressants). Do not exceed the recommended dose. The product may cause drowsiness; do not drive or operate machinery after taking it.
Individual results vary. Testimonials reflect the experiences of individual customers and are not a promise of results.
If you experience a side effect, stop using the product and contact your doctor. Please also tell us at support@trycodez.com or by mail at the address below. We record every report and submit serious adverse event reports to the FDA as required by law.
4. Orders, pricing and payment
All prices are in US dollars. We may change prices, offers and product availability at any time, but changes won't affect orders we've already accepted.
Your order is an offer to buy. We may refuse or cancel an order, for example if a product is unavailable, if there is an obvious pricing or typographical error, or if we suspect fraud. If we cancel after you've been charged, we'll refund you in full.
After checkout we may show you optional one-time offers. If you accept one, the additional item is charged to the payment method you just used, and it is added to your order. We will never charge you for an offer you didn't accept.
We do not sell subscriptions. Every order is a one-time purchase unless the checkout page clearly says otherwise.
5. Shipping, returns and refunds
Shipping is governed by our Shipping Policy, and refunds and cancellations by our Refund Policy, both of which form part of these Terms.
6. Email and SMS messages
If you give us your email address, we may send you order updates and, if you've agreed to receive them, marketing emails. You can unsubscribe at any time using the link in any email.
If you opt in to Code Z text messages, you agree to receive recurring automated marketing and order-related text messages at the number you provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time, or HELP for help. You can also email support@trycodez.com. Carriers are not liable for delayed or undelivered messages.
7. Intellectual property
The Site's content, including text, graphics, logos, product names, and images, is owned by or licensed to Jorgensen Holdings LLC and protected by law. Code Z™ and "Rest well. Wake ready."™ are our trademarks. You may not copy, modify or use our content without written permission.
8. Acceptable use
You agree not to misuse the Site. That includes interfering with its operation, attempting unauthorized access, using it for fraud, or reselling our products without our permission.
9. Disclaimer of warranties
Except as expressly stated in these Terms and as required by law, the Site and products are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, Jorgensen Holdings LLC and its members, employees, suppliers and partners will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Some jurisdictions don't allow these limitations, so they may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Jorgensen Holdings LLC from claims arising from your breach of these Terms or misuse of the Site or products.
12. Governing law
These Terms are governed by the Federal Arbitration Act and, otherwise, by the laws of the State of Wyoming, without regard to conflict-of-law rules.
13. Dispute resolution, binding arbitration and class action waiver
Please read this section carefully. It affects how disputes are resolved.
Informal resolution first. Before starting any claim, you agree to email support@trycodez.com with your name, order number and a description of the issue, and we agree to try to resolve it with you in good faith for 60 days.
Arbitration. If we can't resolve it, you and Jorgensen Holdings LLC agree that any dispute arising out of or relating to these Terms, the Site, or any product bought from us will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, instead of in court. Either party may instead bring an individual claim in small-claims court. The arbitration will take place in the county where you live, or by phone or video. For claims under $10,000, we will pay the AAA filing, administration and arbitrator fees, except for the portion you would have paid to file in court.
Class action waiver. You and we may bring claims only on an individual basis, not as a plaintiff or class member in any class, collective or representative proceeding, and the arbitrator may not combine claims of more than one person. Nothing in these Terms waives any right to seek public injunctive relief that cannot be waived under applicable law; any such request will be decided by a court after the individual claims are arbitrated.
Opting out. You can opt out of this arbitration agreement within 30 days of your first purchase by emailing support@trycodez.com with your name, the email address you ordered with, and a statement that you opt out of arbitration. Opting out won't affect any other part of these Terms.
If the class action waiver is found unenforceable for a claim, this arbitration section will not apply to that claim, and that claim will be brought in the state or federal courts located in Wyoming.
14. Third-party services
Payments are processed by third-party payment processors, and our store runs on third-party platforms. Your use of those services is also subject to their terms.
15. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date shows when they last changed. Changes don't apply to orders placed before the update.
